Why are so many States suing the federal government over the healthcare legislation?

Why are states such as South Carolina, Nebraska, Texas, Utah, Pennsylvania, Washington, Florida, North Dakota, South Dakota and Alabama suing the Federal government over the healthcare legislation?|||Because the part where Americans are required to purchase insurance is contestable. Those states are high in poor people and many will never be able to afford it. Consider that I live in Philly and made almost 40k before getting laid off and could not afford insurance between my other costs of living requirements.





Many of the states you listed have a large portion of very poor people or people on fixed incomes who would fall into that same category I was in. 40K for a family of 2 will not qualify for subsidized health care and we would still get fined for not buying it. This will make the congressmen of that state unhappy since their constituent will not want to re-elect them.|||Because that's how strongly the MAJORITY of states are opposed to it, and they are determined to challenge it and show that it is an unconstitutional interference in an industry that is constitutionally delegated to state control.





This is the states asserting their rights under the constitution. The federal government is attempting to sieze control from the states, when that power was delegated to the states.





The federal government would have to amend the constitution before they could enact this law. They know they don't have the votes to do that, so they are challenging the states to assert their rights.





The states are rising to the challenge.





My question then is, why is any state NOT challenging this law?





What state does NOT wish to preserve and defend its rights under the Constitution?|||My hatred for the legislation aside (and it is strong for many reasons), the general argument against the legislation is that it mandates that everyone buy insurance and more significantly will penalize them if they do not. Car insurance is not the same in that not everyone is forced to drive if they do not want to. If you don't drive, you don't have to pay car insurance. Same with taxes, if you do not have an income, you do not have to pay income tax. Now, Virginia is somewhat unique in that it recently passed a state law prohibiting such a mandate. So in Virginia's case for the federal law to take supremacy (as per the supremacy clause) the federal courts would have to determine whether or not the mandate is constitutional.





The other thirteen states are arguing that the Federal Government is putting an increased financial burden upon them which they cannot accommodate. Some states may have an increased $3 billion in expenses caused by this legislation. All this in a time where schools are being closed and workers are being laid off in droves due to the lack of state funds.





That is why these 14 states (and hopefully soon more) are suing the Federal Government.|||With the new Healthcare Law, States are now required to add more people to the Medicare rolls for insurance and the Federal Government is contributing even less then before, States must now come up with billions of dollars more to pay this additional cost, that mean States will have to cut their budgets, raise taxes or both to comply with the new Law.|||Because the Constitution prevents the Federal Government from forcing any person to purchase a specific product*.

* And don't say that states require people to buy auto insurance, that argument doesn't hold for two reasons, first off, each state, NOT the Federal Government, sets its own rules on auto insurance and second, anyone who doesn't want to buy it is free not to, of course they won't be able to drive, but at least there is a quid pro quo.|||Because they like for profit insurance companies, who pay the CEO's millions upon millions of dollars in annual salaries.


Because they want people who have a pre-existing condition to be priced out of coverage.


Because they enjoy seeing people squirm when they receive another premium increase or deductible increase.


Because they don't want people forced to have health coverage, when they know they cannot be turned away from an emergency room visit. So much for preventive care.


Because they have an antiquated political ideology that is more important than health care for all.|||People have for along time shared there thoughts and feelings about free health care in this country. A majority of people do not want to be forced to buy a good or be penalized for not buying a good that the government says they must. I do not believe these people our greedy for no wanting it, or do not care about the less fortunate, they think logically and have come to the conclusion that this will not benefit our economic situation in anyway for ANYONE. When the government overrides the people it becomes tyranny. These states are simply telling the federal government THEY DO NOT believe that the people should subject to an unconstitutional law. Why did our ancestors fight so hard to leave an oppressive situation and come to this country? Why would we go down the same path once again? This is why so many states are suing the federal government. I am very interested to see what happens.|||Because it is an ill thought out, ill conceived, unconstitutional piece of garbage legislation. if liberals on here would stop their immature having to win at all costs they would see the real liberals out there (the ones with half a brain) even think it is a bad bill that will make insurance companies richer.|||Because the government is going against our Constitutional rights, as mentioned in the Commerce Clause of the Constitution. And for all you brain dead, retard liberals replying to the post, let me inform you on some things:





1) This bill will increase Dr. office lines for one thing, so even if you are covered, it is very unlikely you will get the help and attention you need anyway. Under this bill the government has the right to refuse certain treatments to individuals and it will take a much longer time to process your health claims, thus delaying your treatment.


2) If the government is really concerned about health care, they should be creating jobs for poor people/out of work people, so they can either get covered by their employer or or pay for it themselves. This bill will only make the middle class poorer cause they will be taxted to death, and it will still leave the poor people poor or without jobs. What good does this do, nothing. Nothing is for free and if you thought health care was expensive before, just wait till it is free! You get fined if you opted out!


3) Not to mention the fact how many jobs will be lost in the health care field since the government will be in charge of it. Did you know over 20% of our workforce is composed of those who work in health care? Most of them will probably not have jobs anymore once it goes into effect because this bill will run them out of business.


4) If you can sleep at peace at night knowing that your tax money is being spent on killing innocent babies, then that is all on you. Personally, if you are mad about terrorists killing innocent people, you should be mad about the government using your funds for killing babies who never hurt anyone. It is murder. No way to walk around that. I you think a woman has a right to her body then I have a right to not help her pay for what she does to her body.


5) That fact that even some Democrats from the Douche Bag party needed bribed with higher positions to vote in favor of this bill should scare you. If they needed bribed then you should know this is not good. Sooner or later the positions they were offered with as bribes will come out, and then I am sure many people will be angry.


6) This bill will make the field of a doctor just as valuable as the cashier at your local grocery store. I am sorry, but I want qualified Dr.s that are not stressed out, over worked, and under educated. Sure people will be covered, but the coverage will not be good anyway.


7) Did you know your Constitutional rights were violated? In one of the articles of the Constitution in the Commerce Clause it is pretty clear that no law shall be made that will force citizens into purchasing a government. This is exactly what this is. It leaves no other option. They are creating a monopoly.They just took away your freedom to chose.


8) So if that is true, Obama lied that this new health plan with create more competition. There will be no competition because the government will be in charge of everything.


9) Where do you think that money is going to come from that allows no cap on medical bills? Your pocket. Your taxes. Personally, I do not want to pay for your problems. I want to pay for my own problems. Not the rest of the worlds.


10) This bill covers illegal aliens.. How lovely! I get to even pay health care for people who are not citizens! That makes all the fighting my grandfather and other Vets did in wars so pointless because they fought for the freedom of the people that actually deserve coverage. It is sickening to think of our soldiers defending us and this is how we pay them back? By covering those who should not even be covered...


11) And the best news, since you will be taxed to death, you can have the pleasure of working till you are in your 80s.





That is why states are suing the government. Good for them! Hopefully it will put a stop to this stupid bill. Honestly, for those of you who are not smart enough to think through this and get the facts, you are all completely brain dead and should pick up an economic text book.





Thank God that the states are suing! Not to mention two of the most liberal states, PA, the state I am from, is suing! That should also tell you something. Don't listen to these other uneducated idiots. They either are still in high school, have not done their research, or they are simply people that go with the flavor of the week. Idiots....|||Because they want to waste more tax payer money. They seem to think people will be forced to buy health insurance. How dumb can they get, we are forced to buy car insurance are they going to sue against that as well? The dead beats would love that. How dare they force us to buy car insurance, lets sue them using tax payer money. Just dumb.


Maybe we could sue because we are forced to pay taxes. I would be for that.


Why do we keep electing these stupid people who seem to think just because we are middle class we are all dumber than a politician. Like the granny on social security holding up an anti-socialized medicine picket sign. Hey Granny you already have socialized medicine, it is called medicare. Don't believe anything that comes out of a rich republicans mouth because it is all lies.|||It violates the Constitution and the Tenth Amendment. You cannot require people to purchase a private product; the government is also infringing on the sovereignty of the states.|||It is an unconstitutinal bill it takes away our freedoms over healthcare. Not to mention it will destroy the quality of healthcare we have and the insurance companies in effect destroying the economy.|||Because the Federal government is forcing people to purchase product provided by an entity other than the government.

When the Conservatives take over, the president, with both majority speakers should be tried for seditionist acts, anarchy, and treason!|||Because parts of the bill violate the commerce clause of the Constitution. There are only a few things that do, but they're kind of big points like the mandate.|||It is not legal.You can not make ppl buy insurance.|||It could be the backbreaking cost increases and overreaching of the federal government.|||They're out of money to provide basic services, but they evidently have money to burn on lawyers to tilt at windmills.|||I thought most of the leach politicians in my state were emasculated (washington state). kudos to our AG.|||Because it violates the 10th Amendment.|||It is unconstitutional.|||It's all just politicking. The GOP wants Obama to fail so they can get their power back. They don't give a rat's *** about the American people.|||You need to ask Joe Republican.





Joe Republican gets up at 6 a.m. and fills his coffeepot with water to


prepare his morning coffee. The water is clean and good because some


tree-hugging liberal fought for minimum water-quality standards. With


his first swallow of water, he takes his daily medication. His


medications are safe to take because some stupid commie liberal fought


to ensure their safety and that they work as advertised. All but $10


of his medications are paid for by his employer's medical plan because


some liberal union workers fought their employers for paid medical


insurance - now Joe gets it too.





He prepares his morning breakfast, bacon and eggs. Joe's bacon is safe


to eat because some girly-man liberal fought for laws to regulate the


meat packing industry. In the morning shower, Joe reaches for his


shampoo. His bottle is properly labeled with each ingredient and its


amount in the total contents because some crybaby liberal fought for


his right to know what he was putting on his body and how much it


contained.





Joe dresses, walks outside and takes a deep breath. The air he


breathes is clean because some environmentalist wacko liberal fought


for the laws to stop industries from polluting our air. He walks on


the government-provided sidewalk to subway station for his government-


subsidized ride to work. It saves him considerable money in parking


and transportation fees because some fancy-pants liberal fought for


affordable public transportation, which gives everyone the opportunity


to be a contributor.





Joe begins his work day. He has a good job with excellent pay, medical


benefits, retirement, paid holidays and vacation because some lazy


liberal union members fought and died for these working standards.


Joe's employer pays these standards because Joe's employer doesn't


want his employees to call the union. If Joe is hurt on the job or


becomes unemployed, he'll get a worker compensation or unemployment


check because some stupid liberal didn't think he should lose his home


because of his temporary misfortune.





Joe likes to email his friends. He likes to talk on the phone. He is


secure in his knowledge that everything he says in the email and on


the phone is secure and that no one is listening in or reading his


mail because those commie liberal constitution framers believed that


Joe had the right to privacy. It is noontime and Joe needs to make a


bank deposit so he can pay some bills.





Joe's deposit is federally insured by the FSLIC because some godless


liberal wanted to protect Joe's money from unscrupulous bankers who


ruined the banking system before the Great Depression. Joe has to pay


his Fannie Mae-underwritten mortgage and his below-market federal


student loan because some elitist liberal decided that Joe and the


government would be better off if he was educated and earned more


money over his lifetime. Joe also forgets that his in addition to his


federally subsidized student loans, he attended a state funded


university.





Joe is secure in his walk to the bank with the knowledge that no


police agency has the right to arrest and jail him without due process


and probable cause. He has the right to an attorney, a jury of his


peers and to be brought before a magistrate in a timely fashion. His


family has the right to know he has been arrested. Again Joe can thank


those commie constitution framers.





Joe is home from work. He plans to visit his father this evening at


his farm home in the country. He gets in his car for the drive. His


car is among the safest in the world because some America-hating


liberal fought for car safety standards to go along with the tax-payer


funded roads. He arrives at his boyhood home. His was the third


generation to live in the house financed by Farmers' Home


Administration because bankers didn't want to make rural loans. The


house didn't have electricity until some big-government liberal stuck


his nose where it didn't belong and demanded rural electrification.





He is happy to see his father, who is now retired. His father lives on


Social Security and a union pension because some wine-drinking, cheese-


eating liberal made sure he could take care of himself so Joe wouldn't


have to.





Joe gets back in his car for the ride home, and turns on a radio talk


show. The radio host keeps saying that liberals are bad and


conservatives are good. He doesn't mention that the beloved


Republicans have fought against every protection and benefit Joe


enjoys throughout his day. Joe agrees: "We don't need those big-


government liberals ruining our lives! After all, I'm a self-made man


who believes everyone should take care of themselves, just like I have."





Did I tell you that Joe doesn't have to worry about health care anymore because of those darn liberal progressives?|||Posers - they know better. They expect the public to go into turmoil and they want to appear to be fighting against it.





There is nothing illegal in the bill or in the way it was passed.
